Terms of Service

1. Who may use the Service

You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is greater, to use the Service. By using it you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Your account

You sign in using Google or a one-time email code. You are responsible for the activity that happens under your account and for keeping access to your email or Google account secure. Provide accurate information and keep it up to date.

3. What the Service does

New Obscura lets you upload a photo of a face and generates AI-created, fictional cinematic film stills that place that likeness into predefined titles and scenes. All output is computer-generated and fictional. It is not a real photograph, does not depict real events, and may contain inaccuracies or artifacts.

4. Photos you upload and the rights you grant

You represent and warrant that, for every photo you upload, you:

• are the person shown, or have the explicit consent of the person shown;
• have all rights necessary to upload the photo and have it processed as described here;
• are not uploading a photo of a minor or of any person who has not consented.

You retain ownership of the photos you upload. You grant us a limited, worldwide, royalty-free license to host, store, process, and transmit your photos and the resulting images solely to operate and provide the Service to you — including transmitting them to the third-party AI providers that perform image generation (see our Privacy Policy).

5. Acceptable use

You agree not to use the Service to:

• upload images of other people without their consent, or images of minors;
• impersonate, harass, defame, or harm any person, or create misleading “deepfake” content;
• create sexual, violent, hateful, deceptive, or otherwise unlawful content;
• infringe anyone’s intellectual property, privacy, or publicity rights;
• attempt to reverse engineer, scrape, overload, or circumvent the Service or its limits.

6. Credits and payments

The Service uses credits. Credits are sold in one-time packs (not a subscription) and are processed by our payment provider, Polar. Each generation deducts credits at the rate shown before you confirm it; credits may be deducted before generation begins. Credits and purchases are for your personal use, are non-transferable, and have no cash value.

Except where required by law, payments and consumed credits are non-refundable. If a generation fails for technical reasons on our side, the credits for that generation are returned to your balance. We may change pricing or credit costs prospectively.

7. Intellectual property

The Service, the titles, scenes, prompts, artwork, and all related materials (other than your uploaded photos) are owned by us or our licensors. Subject to these Terms and your payment of the applicable credits, we grant you a personal, non-exclusive license to use the film stills you generate for your own personal, non-commercial purposes. Commercial use requires our prior written permission.

8. AI-generated content disclaimer

Output is generated by machine-learning models and is provided “as is.” It may be inaccurate, unexpected, or fail to resemble the uploaded likeness. We do not guarantee any particular result, quality, or likeness fidelity.

9. Third-party services

The Service relies on third parties (for example, payment, authentication, hosting, and AI image generation providers). Your use of the Service may be subject to those providers’ terms, and we are not responsible for their acts or omissions.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to others or to us. Sections that by their nature should survive termination will survive.

11. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the three months before the claim or USD 50.

13. Indemnification

You agree to indemnify and hold us harmless from claims and expenses arising out of the photos you upload, the content you generate, or your breach of these Terms — including any claim that a photo was uploaded or used without the depicted person’s consent.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you. Continued use after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules. The courts located in the Republic of Korea will have exclusive jurisdiction, unless mandatory law provides otherwise.
